Terms & Conditions

Applies to all services offered by Scayver Photography

1. Service Agreement

By booking a session with Scayver Photography, you agree to all terms outlined in this agreement, including those related to payment, copyright, session etiquette, and delivery timelines.

2. Booking and Payments

A non-refundable 50% retainer is required to secure your booking.

The remaining balance is due no later than the session date (or 30 days prior for weddings/events).
Bookings are not confirmed until the deposit is received.
Payments are accepted via digital invoice, credit/debit card, or approved platforms.

3. Rescheduling & Cancellations

Sessions may be rescheduled once with 24 hours’ notice.
No-shows or last-minute cancellations may incur a $50 rescheduling fee.
Retainers are non-refundable, including in the case of event cancellations.
In case of emergencies or weather issues, we’ll work to reschedule promptly.

4. Session Conduct

Arrive 10 minutes early.
No cameras, cell phones, or guests not being photographed.
For children's sessions, keep distractions to a minimum.
Photographer reserves the right to end sessions early for non-cooperative behavior without a refund.

5. Copyright & Usage Rights

All images are the property of Scayver.
Clients receive edited, high-resolution images for personal or commercial use (depending on session type).
Raw files or unedited images will not be provided.
You may not alter, filter, or crop images without permission.
Web images will include a watermark unless otherwise arranged.

6. Delivery Timeline

Portrait, newborn, family, and branding sessions: Up to 4 weeks
Weddings and large events: Up to 10–12 weeks
Final images are delivered via downloadable gallery or USB (if purchased)

7. Albums & Prints

Album production begins once image selections are finalized and paid in full.
Custom albums require additional time and proof approval.
All print and album orders are final.

8. Image Backup

We recommend backing up your files.
We may retain image backups, but this is not guaranteed long-term.
Reuploading galleries after expiration incurs a $50 reactivation fee.

9. Model Release

By signing your agreement and completing your session, you grant Scayver Photography the right to use your images for portfolio, web, and promotional purposes unless stated otherwise in writing.

10. Limitation of Liability

If Photographer cannot fulfill the contract due to illness, emergency, equipment failure, or uncontrollable events, liability is limited to the refund of any fees paid. Scayver Photography will not be held liable for lost or damaged files after delivery.

11. Governing Law

These terms are governed by the laws of the State of Florida. Any disputes will be resolved in a court of competent jurisdiction in Palm Beach County, FL.

12. Acceptance

By booking any service or submitting payment, you confirm you have read and agreed to these terms and conditions.
